BP 2430 Delegation of Authority to S/P
July 10th, 2008“The Board delegates to the S/P the executive responsibility for administering the policies adopted by the Board and executing all decisions of the Board requiring administrative action.”
“The S/P shall make available any information or give any report requested by the Board as a whole. Individual trustee requests for information shall be met if, in the opinion of the S/P, they are not unduly burdensome or disruptive to District operations. Information provided to any trustee shall be available to all trustees.”

The above board policy could be broadly interpreted to mean that unless the “board as a whole” agrees with an elected board members request for information, administration does not need to provide said information. The policy allows a public agency to be non-accountable to an elected members requests for public information and thus prohibits a public official in the performance of their fiduciary responsibility to taxpayers.
Allowing a public employee to deny information requests from an elected public oversight official is bad public policy.



Failure to provide public information is not only bad public policy, it’s also illegal. This Board policy is not in conformance with Government Code 6250, The California Public Records Act. Why?
Seems to be a track record of this sort of thing from the administrators at MSJC. They pick and choose who to respond to and how.
No consistency.
